GENERAL PURCHASE CONDITIONS 

We inform you that, any purchase made through the web www.bricoandpool.com and their high/registration process as a user, will be regulated by these “general purchase conditions”, (hereinafter, “general conditions”). The purchase / hiring of any of our irrigation and pool products offered, involves the acceptance of these general conditions, and therefore, the acceptance of our legal notice and the acceptance of our applicable privacy policy.

The general conditions link the head of the page and the buyer (client), granting them a series of rights and obligations, from the moment it makes and accepts an order through this page. They are mandatory and knowledge by both parties, so their acceptance is essential to formalize an order. Therefore, the client must read these general conditions carefully.

Buyer/Client: User who registered by consigning your personal data requested, voluntarily, in the enabled form. To make a purchase, it will be necessary for the customer/user to register or registered as a user of the web, and fully and unreservedly accept all of these general conditions, the legal notice, and our privacy policy.

Products: Bricoandpool makes available to users/customers its catalog of cleaning and maintenance products of pools, irrigation pumps, drainage pumps and wastewater, or irrigation programmers and any of its related products that are offered on the website www.bricoandpool.com.

As a client, you declare to be of legal age and dispose of sufficient legal capacity to link due to these general conditions when placing an order on our website. Notwithstanding the foregoing, you accept, expressly and without exceptions, that access, registration and hiring through the web takes place under its only and exclusive responsibility.

The holder takes all possible measures to ensure that all prices information shown on the site is correct and updated. However, there are sometimes errors. If an error occurs and an erroneous price is assigned to a product, the person in charge may not accept the order and/or confirm the validity of the contract, according to what is willing here. Bricoandpool has no obligation to supply or deliver any product whose price has been erroneously assigned, to the extent that the amount of the product has not been charged and the order has not been processed.

Shipping expenses may be charged, which must be clearly shown during the order making. The total shipping cost must be detailed and identified on the payment screen and on the invoice issued. The prices indicated are with the VAT included.

1.- Shipments to Peninsula, Balearic Islands

National shipments: All products of the Bricoandpool online store will be delivered within a period not exceeding 1-2 working days in peninsular territory as long as they have stock at the time of purchase.

Bricoandol informs their customers that shipments outside the peninsula, the products will be delivered within a period not exceeding 5-6 working days as long as they have stock at the time of purchase. 

International shipments: All products of the Bricoandpool online store will be delivered within a period not exceeding 7 days for international shipments within the European Union.

All purchases are issued with their corresponding order and invoice agar, which will be sent to the purchase process.

PAYMENT FORMS:

  • Credit/Debit card: All operations that involve the transmission of personal or bank data are carried out using a safe environment, a server based on standard SSL (Secure Socked Layer). Your order will be processed when we can validate the payment made, so we recommend that you send us justifying via email (info@bricoandpool.com), being this voluntary shipment, we are delighted that if the proof by any of these means its order will be made will be processed as soon as possible.

Guarantee and returns

Next, we inform you how to proceed in each case:

  1. Damaged product during shipping: Upon receiving the product you must check it well. If you check that it has been damaged during shipping you should contact us immediately through our contact paths or by calling the number 670 26 95 74 where we will indicate the way to proceed.
  1. Incorrect product: In the event that we have been wrong in sending the product, it has 15 calendar days from the date of receipt of the order to return the same. Please contact our customer service at the email address: incidencias@bricoandpool.com

All products have a 2 -year guarantee of the manufacturer. This guarantee does not include the deficiencies caused by negligence, blows, use or improper manipulations, incorrect installation not carried out by the authorized installer when appropriate, or materials subjected to wear due to its normal use.

The guarantee will lose its value if they are modified, alter or replace some of the data of the same or the purchase proof. To make use of the guarantee, the presentation of the purchase proof is essential.

The legal rights established in accordance with the national legislation that regulates the sale of consumer goods are not affected by this guarantee.

Return policy:

Make sure that, when you receive an article, take care of it reasonably when you try it and make sure that safety stamps or labels are intact. It has 15 days from the date of receipt of your order to initiate a return, provided that the product has not been used, altered or manipulated and is in its original box and seal. To fulfill the period of withdrawal, it is enough that the communication relative to the exercise for its part of this right is sent before the corresponding term come.

In case of withdrawal on your part, we will return all the payments received from you, except the delivery expenses without any undue delay and, in any case, no later than 15 calendar days from the date on which we are informed of your decision to give up this contract. We can retain the reimbursement until you have received the goods, or until you have presented a test of their return, according to what condition is fulfilled first.

You must return or give us directly the goods to the address that we will indicate once your decision to withdraw from the contract, without any undue delay and, in any case, no later than 15 calendar days from the date on which you communicate your decision to withdraw the contract. The deadline will be considered fulfilled if it makes the return of the goods before this period has concluded. You must assume the direct cost of return of the goods. You will only be responsible for the decrease in value of the goods resulting from a manipulation other than that necessary to establish the nature, characteristics and operation of the goods.

It is important that you check the status of your order or items when you receive them and always before use in the 48/72 hours from your reception. If errors are produced or problems arise, you will have to contact our customer service so that we can discern the cause in the following 48/72 hours from receipt. What to do if I have received an incorrect article?

What to do if I received a defective product?

Our goal is to ensure that all products and orders meet the highest quality standards. However, problems can rarely give.

The quality control equipment will check the facts and try to solve the problem within 24 to 48 hours. Please keep in mind that some checks may take longer if the product comes from a supplier/manufacturer.

What should I do to return a product?

Please contact our customer service team (incidencias@bricoandpool.com) to proceed to return the desired article.

To proceed to the return, you will have to inform us of the order number, the product you want to return and the reason. Our equipment will then provide a return number and the address to which the product will be sent.

You will have to pack the product safely and include a copy of the return form.

When you will return a product, remember to ask for the courier company. This will serve as a shipping test until you receive the product change or the money is returned. Without this receipt we will not be able to process your reimbursement or replacement in case the article is lost during transport.

Every defective product will be changed to the same product and we would proceed to return the money to the same account in case said product was not in stock.

Any article you have accepted and then returned is your responsibility until you reach our warehouse. Therefore, please make sure you send your article with a delivery service that ensures the value of the goods.

Return of shipping costs

We will be delighted to reimburse shipping costs if the return has been requested due to our error. For example;

  • If we send an incorrect article
  • If the article is damaged or defective
  • If after returning an article, receive another replacement and do not want

We will not return the shipping costs for unwanted articles or does not need. You will have to pay these expenses and, once again, we recommend the use of a delivery service that ensures the value of the articles.

 

We will not return the shipping costs for any return article due to damage or reported failure where said error is not found when trying the product. The cost of sending the article again will depend on the article and will be communicated once the test process is completed.

Modification of the conditions of sale and use

Bricoandpool reserves the right to modify at any time, the presentation and configuration of the website, as well as these general conditions. Therefore, Bricoandpool recommends the customer and/or user read them carefully every time he access the website.

Customers and users will have these general conditions in a visible site, freely accessible for how many consultations they want to make. In any case, the acceptance of the conditions of sale and use will be a previous and indispensable step to the acquisition of any product available through the website.

Confidentiality, privacy and data protection.-

Bricoandpool respects the right of all people to the protection of their personal data, as this term is defined, and the right of all people to integrity in relation to the processing of personal data. Bricoandpool requires its suppliers to comply with all applicable laws and the normative requirements associated with privacy and information security, such as the General Data Protection Regulation (RGPD) and the LOPD-GDD 3/2018, as well as the information and privacy security policies of the holder, and any other specific measure that can be established in the formalized contracts between the company and the collaborators/suppliers.

FORCE MAJEURE

We will not assume any kind of responsibility for the breach of any of the obligations contained in these conditions due to the existence of an alleged alien to our reasonable control (assumption of force majeure), including (on the way of indicative) strikes, pandemics, employer closures, third -party systems or networks failures, fortuit Terrorism, deliberate sabotage or intentional damage to equipment or data, damages or destruction of facilities or equipment, regulations or government policies and shortage of supply and services (a “assumption of force majeure”).

Compliance by our part of the contract will be considered suspended while there is the assumption of force majeure, and the fulfillment period will be extended for the deadline that this assumption lasts. We will reasonably end up ending this situation or finding a solution to comply with the obligations collected in the contract even when the existence of the aforementioned assumption of force majeure lasts.

Applicable legislation and jurisdiction

These general conditions of purchase are governed by Spanish law. For the resolution of any controversy that may arise with respect to its validity, execution, compliance or resolution (total or partial) are submitted to the competence of the courts of Malaga. This contract constitutes the complete and complete expression of the agreement between Bricoandpool and the user/client. The use of the portal attributes the condition of user and implies full and unreserved acceptance of each and every one of the provisions included in the Legal notice. 

Online litigation resolution in accordance with Art. 14.1 of Regulation (EU) 524/2013: The European Commission facilitates a online litigation resolution platform, which is available in the following link: http://ec.europa.eu/consumers/odr/.
